General terms and conditions 'the Tan Studio Antwerp'

1. General

These terms and conditions apply to every offer, treatment and transaction between Spraytan - Antwerp; the Tan Studio Antwerp and a client to whom Spraytan - Antwerp; the Tan Studio Antwerp has declared these terms and conditions applicable, insofar as the parties have not expressly deviated from these terms and conditions in writing. By using any service of 'Spraytan Antwerp / the Tan Studio' and/or by contacting 'Spraytan Antwerp / the Tan Studio' you expressly acknowledge that you will comply with these terms and conditions. These terms of use constitute a legally binding agreement between 'Spraytan Antwerp / the Tan Studio' and yourself. All disputes regarding the services sensu lato as well as all disputes between parties regarding agreements that are subject to these general terms and conditions, fall under the exclusive jurisdiction of the court of the judicial district applicable for the Antwerp region.

2. Efforts salon

• 'Spraytan Antwerp / the Tan Studio' will carry out the treatments to the best of its knowledge and ability and in accordance with the requirements of good workmanship and on the basis of the treatment method known and requirements currently applicable for us.
• 'Spraytan Antwerp / the Tan Studio' performs well-known and applicable treatment methods.
• 'Spraytan Antwerp / the Tan Studio' will as much as reasonably possible inform the client about financial consequences of the change or addition to the treatment.

3. Appointments and cancellation

An appointment made by phone, in the salon or by e-mail is binding. This is because time will be reserved for the client. The client must inform 'Spraytan Antwerpen/The Tan Studio' as soon as possible, but no later than 24 hours prior to the appointment, if he/she is unable to attend an appointment via the known telephone number as mentioned on the website of 'Spraytan Antwerpen/The Tan Studio'. If you want to cancel an appointment, please let us know at least 12 hours before the scheduled appointment. If you do not cancel your appointment ( on time ) we are unfortunately forced to charge 30% of the treatment. Both parties need not comply with these obligations if they are hindered by force majeure. Force majeure includes what the law and jurisprudence says about it.

4. Payment

As a customer of 'Spraytan Antwerp / The Tan Studio Antwerp' you agree to the agreed price for the spraytan treatment. The price mentioned on our website and social media channels includes VAT. Should there be an unexpected change in the price of our treatments, we will announce this at least 30 days in advance on our website and social media channels.

5. Gift vouchers

At 'Spraytan Antwerp / The Tan Studio Antwerp' we offer gift vouchers for our spraytan treatments. This is a great gift for friends and family who would like to have a beautiful and natural complexion. Our gift cards are available in different amounts and can be redeemed for any spraytan treatment we offer.

Please be advised that the minimum age for our spraytan treatments is 16 years old and this rule also applies to redeeming gift vouchers. We want to make sure our clients are of the appropriate age to safely and responsibly use our services.

6. Personal data & privacy

The client provides 'Spraytan Antwerp / the Tan Studio' before the first treatment with all the information which the salon indicates is necessary or which the client should reasonably understand is necessary for the careful execution of the treatments.

At 'Spraytan Antwerp / The Tan Studio Antwerp' we treat the confidential data of our clients according to the guidelines in the 'General Data Protection Regulation' ( Dutch: AVG ). Within our organization, client data is not sold / leased to third parties without prior written consent of the client.

7. Confidentiality

At 'Spraytan Antwerp / The Tan Studio Antwerp' we value the privacy and confidentiality of our clients. All confidential information provided during the treatment is handled and kept strictly confidential. We will not provide this information to third parties, except in the following cases:

• If we are required by law to provide the confidential information to third parties;
• If we are required by a court order to provide the confidential information to third parties;
• In these cases, we will only provide the information that is strictly necessary to fulfill our legal obligations. We will always inform our customers and notify them of the disclosure of the information.

8. Liability

At 'Spraytan Antwerp / The Tan Studio Antwerp' we bear no liability for any form of damage caused by incorrect or incomplete information provided by the client regarding relevant physical conditions, allergies, use of medication, work or leisure activities. We are also not liable for any loss, theft or damage to personal property of the customer, which he/she has brought to our spraytan salon or to the location where the treatment takes place.

It is important that the customer is aware that the spray tan treatments we offer are entirely at their own risk. Our specialists will provide instructions during the treatment to minimize any risks.

9. Warranty

As a client of 'Spraytan Antwerp/The Tan Studio', it is important to know that the spray tan usually lasts 4-7 days, depending on your skin type and the care of your skin.

Before the treatment begins, you should scrub your skin thoroughly 24 hours in advance. After the spray tan treatment, it is important to keep your skin hydrated and avoid taking long baths, showering or swimming in salt water. 

After the treatment, avoid tight clothing, perspiration and sitting on light fabrics, and do not shower for at least 8 hours. After these 8 hours, you are free to perform these activities again.

If you are allergic, it is important to review the ingredients list of the spray tan before undergoing treatment. Spray tan does not protect against UV rays, so it is important to protect yourself from overexposure to UV rays.

If you have booked a spray tan treatment at home, be sure to provide a space where there is adequate light. The spray tan tent measures 1 meter by 1 meter and has a height of 2 meters. The space must have good ventilation options and be free of pets and dust.

At 'Spraytan Antwerp/The Tan Studio' we provide a 4-6 day warranty on the treatment and a two week (14 day) warranty on the products. This warranty expires if you use other products than those recommended by us, do not follow the advice before and after treatment, do not follow the advice to seek medical attention within two working days or do not use the products according to the instructions for use.

10. Damage & theft

As a client of 'Spraytan Antwerpen/The Tan Studio Antwerp' you should be aware that you could be held liable for any damage to our furniture, equipment or products during your treatment and this can lead to damages. In addition, we would like to advise you that we will report any theft to the police.

11. Complaints

At 'Spraytan Antwerp /The Tan Studio Antwerp', we strive for the highest quality in our spray tan treatments and customer service. We want to ensure that our clients are satisfied with their treatments and experiences in our studio. However, if something does go wrong or is not to your satisfaction, we would love to hear from our clients.

If you have a complaint about our services or treatments, we encourage you to report it to us as soon as possible. We will take your complaint seriously and make every effort to work with you to find a solution. This may range from a re-treatment to a partial or full refund.

We kindly ask our customers to communicate their complaint to us first, so that we have a chance to solve the problem and improve where necessary. Should you nevertheless not be satisfied with the handling of your complaint, you can also refer it to the relevant arbitration commission.

12. Proper conduct

At 'Spraytan Antwerp, The Tan Studio Antwerp', we value proper conduct of our clients. We expect our clients to treat our staff and other clients with respect. Discrimination, intimidation and aggression are not tolerated in our studio and we take complaints about this very seriously.

We ask our clients to arrive on time for their appointments and to cancel them on time if it is impossible to come. If something is unsatisfactory during treatment, we encourage our clients to report it to our staff immediately so that we can resolve the problem as soon as possible.

We also expect our clients to follow our staff's instructions regarding spray tan treatment and aftercare. This way, we ensure that the spray tan lasts as long as possible and looks as natural as possible.

13. Age

At 'Spraytan Antwerpen/The Tan Studio Antwerp' we have a minimum age of 16 years to undergo a spray tan treatment. It is important to us to treat our clients responsibly and that includes the age of the client. We therefore always ask for proof of identity from our clients to check their age. If a client is younger than 16 years old, we unfortunately cannot perform a spray tan treatment. We hope you understand this rule and are always open to questions about it.
